Matchpoint40 – Release of Liability and Indemnification Agreement

This Release of Liability (“Release”) is entered into between J&C Sports & Coaching LLC, doing business as Matchpoint40 (“Matchpoint”; "Matchpoint40") and the hiring participant (“Client”; "client") in connection with the Client’s voluntary participation in racquet sports training programs, activities, and related use of facilities and equipment.

Release of Liability

The Client fully and irrevocably releases and discharges Matchpoint40, together with its owners, officers, directors, employees, coaches, contractors, representatives, and affiliates (collectively, the “Released Parties”), from any and all claims, demands, damages, actions, or causes of action of any kind, whether known or unknown, that may arise out of or relate in any way to the Client’s participation in lessons, training programs, or use of Matchpoint40’s facilities and equipment. This release applies to injuries, illnesses, accidents, property loss, or even death, whether caused in whole or in part by the negligence of the Released Parties or by any other circumstance.

Assumption of Risk

The Client acknowledges and accepts that racquet sports, physical training, and athletic activities involve inherent risks, including but not limited to slips, falls, collisions, overexertion, equipment malfunction, weather conditions, and unforeseen accidents. By signing this Release, the Client freely and voluntarily assumes all risks associated with participation and agrees to be solely responsible for their own safety.

Indemnification and Hold Harmless

The Client agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all losses, damages, costs, or expenses, including reasonable attorney’s fees, arising out of or relating to the Client’s participation in Matchpoint40’s training programs or use of its facilities. This obligation extends to claims brought by third parties, claims of negligence, or any other legal actions connected to the Client’s participation.

Acknowledgment of Understanding

By signing this Release, the Client confirms that they have carefully read and fully understand its contents. The Client acknowledges that signing this Release is a mandatory condition of participation in Matchpoint40 activities, and that by signing, they are giving up substantial legal rights, including the right to sue the Released Parties for claims based on negligence. The Client affirms that they sign this Release voluntarily and without coercion.

Scope and Duration

This Release applies to all present and future activities provided by Matchpoint40, including but not limited to lessons, drills, practices, competitions, and use of equipment or facilities, whether on or off premises. The Release is intended to be as broad and inclusive as permitted by the laws of the State of Florida. If any portion is found unenforceable, the remaining provisions shall remain in full force and effect.

Client Agreement and Signature

By engaging Matchpoint40’s services, the Client affirms that they have carefully read and fully understood this Release of Liability and Indemnification Agreement. The Client further acknowledges that they voluntarily and willingly agree to its terms, and confirm their full acceptance without reservation.
